Welcome to Talk2Us. These Terms of Service ("Terms") are an agreement between you and Talk2Us ("Talk2Us," "we," "us") and govern your use of our website www.talk2us.shop and our service. By creating an account or using Talk2Us, you agree to these Terms. If you don't agree, please don't use the service.

The short version

Talk2Us lets you collect anonymous customer feedback and see plain-English summaries.
Every plan starts with a 30-day free trial; a card is required to begin.
If you don't cancel before the trial ends, your card is charged and your plan renews automatically until you cancel.
You can cancel anytime from your dashboard.
Be honest and lawful in how you use it; we provide the service "as is."

1. What Talk2Us provides

Talk2Us is a tool that lets a business collect anonymous feedback from its customers, usually through a QR code or link, and view that feedback, along with automatically generated summaries, in a dashboard. Features may include branded feedback pages, printable table stands, an optional email-collection tool, and AI summaries. We may add, change, or remove features over time.

2. Who can use it

You must be at least 18 years old and able to enter into a contract. If you use Talk2Us on behalf of a business, you confirm that you're authorized to accept these Terms for that business.

3. Your account

Provide accurate information when you sign up and keep it current.
Keep your password secure. You're responsible for activity that happens under your account.
Tell us promptly if you believe your account has been accessed without permission.

4. Free trial, plans & billing

Please read this section carefully, it explains how charges work.

Free trial

New subscriptions start with a 30-day free trial. A valid payment method is required to begin the trial. You won't be charged during the trial, and you can cancel anytime before it ends to avoid any charge.

Automatic renewal, please note: Unless you cancel before your free trial ends, your payment method will be automatically charged the plan price when the trial ends. After that, your subscription renews automatically at the start of each billing period (monthly or yearly, depending on the plan you chose) at the then-current price, until you cancel.

Plans & prices

Local (1 location): $24.99 per month, or $269.89 per year (10% off).
Multi (up to 5 locations): $49.99 per month, or $539.89 per year (10% off).

Prices are in U.S. dollars and don't include any applicable taxes, which may be added. We may change our prices, and if we do, we'll give you advance notice; changes apply to your next billing period.

Cancelling

You can cancel anytime from your dashboard's billing area (which opens our payment processor's secure portal). Cancellation stops future charges and takes effect at the end of your current paid period, you keep access until then.

Refunds

Except where required by law, payments are generally non-refundable, and we don't provide refunds or credits for partial periods. That said, we want you to be happy, if something went wrong, contact us and we'll do our best to make it right.

Payments

Payments are processed by Stripe. Your card details are handled by Stripe under its own terms; we never receive or store your full card number. If a payment fails, we may suspend or limit your account until it's resolved.

5. Acceptable use

When using Talk2Us, you agree not to:

Break the law, or use the service for anything fraudulent, harmful, or deceptive.
Collect feedback in a misleading way, or alter or fabricate feedback to deceive others.
Upload content that is illegal, hateful, harassing, infringing, or that you don't have the right to use (including logos and images).
Attempt to break, overload, probe, or bypass the security of the service, or access another business's data.
Resell or sublicense the service, or copy it, without our permission.
Use automated means to spam the feedback system or scrape the service.

We may remove content or suspend accounts that violate these Terms.

6. Your data and your customers

You're responsible for how you collect and use the feedback and any email addresses you gather through Talk2Us, and for complying with the privacy and marketing laws that apply to your business.
You confirm you have the right to use any branding, logos, and images you upload.
For the feedback you collect, Talk2Us acts as a service provider that processes that information on your behalf so we can run the service for you.
How we handle information is described in our Privacy Policy, which is part of these Terms.

7. Feedback content

Feedback is submitted anonymously by your customers and reflects their own opinions. We don't verify, endorse, or take responsibility for the accuracy of feedback, and AI summaries are generated automatically from that feedback. You're responsible for how you interpret and act on what you receive.

8. AI summaries

Talk2Us uses AI to summarize feedback into plain language. These summaries are provided for convenience, may contain mistakes or omissions, and are not professional, legal, or business advice. Use your own judgment before acting on them.

9. Intellectual property

Talk2Us and everything that makes up the service (software, design, and branding) belong to us. You keep ownership of the content and branding you provide. You grant us a limited license to host, display, and process your content as needed to operate the service for you.

10. Service availability

We work hard to keep Talk2Us running reliably, but we provide it on an "as available" basis and don't guarantee it will be uninterrupted or error-free. We may perform maintenance, and we may modify or discontinue features.

11. Disclaimers

To the fullest extent permitted by law, Talk2Us is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will meet your requirements or that results (including AI summaries) will be accurate or reliable.

12. Limitation of liability

To the fullest extent permitted by law, Talk2Us will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

13. Indemnification

You agree to defend and indemnify Talk2Us against claims, losses, and expenses arising from your use of the service, your content, or your violation of these Terms or of any law or third-party right.

14. Termination

You can stop using Talk2Us and close your account at any time. We may suspend or terminate your access if you violate these Terms or if needed to protect the service or other users. When your account ends, your right to use the service stops, and we handle your data as described in our Privacy Policy.

15. Changes to these Terms

We may update these Terms from time to time. When we make changes, we'll update the "Last updated" date, and for material changes we'll provide a more prominent notice. If you keep using Talk2Us after the changes take effect, you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. Any dispute will be subject to the courts located in New Jersey, unless applicable law requires otherwise.
